Proposed Rules To Implement and Give Effect to HB 107: An Act to Make Changes to the Educator Preparation Program Performance Standards and Data Reporting System

Public Notice

Notice is hereby given in accordance with G.S. 150B-21.2 that the North Carolina State Board of Education intends to adopt the following rules cited as 16 NCAC 06C .0334 - .0346 and to repeal 16 NCAC 06C .0326 and 16 NCAC 06C .0329.

Proposed Rules and Reason for Proposed Action

Section 4 of Session Law 2019-149,  states that, “By October 1, 2019, the State Board of Education shall adopt the rule required by G.S. 115C-269.45(c1), as enacted by this act, and shall report on the rule to the Joint Legislative Education Oversight Committee. The State Board shall apply the rule beginning with data collected from the 2018-2019 academic year for the purposes of the annual report made available to the public by December 15, 2019, and annually thereafter, pursuant to G.S. 115C-269.50.” On September 19, 2019, the State Board fulfilled this legislated requirement by adopting rules concerning accountability for Educator Preparation Programs in a manner consistent with law.

16 NCAC 06C .0334 – Educator Preparation Programs (EPP) Accountability Requirements and Risk Factors

16 NCAC 06C .0334 – Educator Preparation Programs (EPP) Accountability Requirements and Risk Factors is proposed for adoption to establish the three accountability measures: Annual Teacher Evaluation, Student Growth, and Recent Graduate Survey. NCDPI will collect data to evaluate and compute the effectiveness of each Educator Preparation Program in the state of North Carolina using these three measures as well as providing a definition of “beginning teacher.”

16 NCAC 06C .0335 – Annual Teacher Evaluation

16 NCAC 06C .0335 – Annual Teacher Evaluation is proposed for adoption to establish that the North Carolina Educator Effectiveness System (NCEES) evaluation tool is used to constitute the Annual Teacher Evaluation accountability measure for each recognized Educator Preparation Program (EPP). Within this rule, the standards, ratings, and data calculation method for this measure are explained.

16 NCAC 06C .0336 – Student Growth is proposed for adoption to establish that the North Carolina Education Value Added Assessment System (EVAAS) is used to constitute the Student Growth accountability measure for each recognized Educator Preparation Program (EPP).  Within this rule, the data calculation method, ratings, and definition of EVAAS are explained.

16 NCAC 06C .0337 – Recent Graduate Survey is proposed for adoption to establish this tool as one of the accountability measures for each recognized Educator Preparation Program (EPP). Within this rule, the question criteria, number of items, and the data calculation method for this measure are explained.

16 NCAC 06C .0338 – Conditions for Determining Accountability is proposed for adoption to establish how the three accountability measures for Educator Preparation Programs – Annual Teacher Evaluation, Recent Graduate Survey, and Student Growth – determine accountability for each recognized Educator Preparation Program (EPP) in North Carolina.

16 NCAC 06C .0339 – Four Point System for Evaluating EPP Effectiveness

16 NCAC 06C .0339 – Four Point System for Evaluating EPP Effectiveness is proposed for adoption to establish the four-level system that accountability thresholds shall use to evaluate the effectiveness of each recognized Educator Preparation Program.

16 NCAC 06C .0340 – Accountability Measure Conditions

16 NCAC 06C .0340 – Accountability Measure Conditions is proposed for adoption to establish that the North Carolina Department of Public Instruction shall measure Educator Preparation Program performance on each of the accountability measures in the aggregate overall level and by subgroup. In addition, the sample size and the small group exception rule is provided in this rule.

16 NCAC 06C .0341 – Annual Performance Reports

16 NCAC 06C .0341 – Annual Performance Reports is proposed for adoption to establish that all recognized Educator Preparation Programs (EPP) shall submit to the State Board of Education annual performance reports. These reports must include 11 indicators as listed in this rule.

16 NCAC 06C .0342 – Educator Preparation Program Sanctions

16 NCAC 06C .0342 – Educator Preparation Program Sanctions is proposed for adoption to establish the three reports – the EPP Annual Performance Report, the EPP Report Card, and the Risk Assessment – to assess the ongoing quality of EPPs. These reports are issued by the North Carolina Department of Public Instruction (NCDPI) and information from these reports will be used to levy sanctions. EPPs with an assigned sanction by the State Board of Education shall have specific requirements, such as additional reporting, to fulfill that sanction status.

16 NCAC 06C .0343 – Assigning Sanctions is proposed for adoption to establish the three types of sanctions, Warned, Probation, and Revoked, that can be assigned to an Educator Preparation Program (EPP) if the EPP achieves a Level 1 status on a State Board of Education accountability measure. In addition, the condition for an EPP to be designated a Level 1 status is established in this rule.

16 NCAC 06C .0346 – Revoked Status Sanctions is proposed for adoption to establish the requirements for a revoked status that is assigned to any Educator Preparation Program. In addition, this rule states what conditions the Educator Preparation Program must complete and follow when this specific status is assigned.
